Fair Use Policy – Creative and Marketing

1. Scope of Services

Service Inclusions:
  • Tier Lite: Offers 15 hours per month of advertising services, including digital marketing research, strategy, and media planning.
  • Tier 1: Provides 25 hours per month of enhanced advertising and creative services.
  • Tier 2: Includes 50 hours per month, covering extensive advertising services, creative services, and some production services.
  • Tier 3: Encompasses 75 hours per month of comprehensive services across advertising, creative, production, and support services.
Exclusions:
  • Services not specified within the designated hours or described tasks for each tier will be considered out of scope and subject to additional negotiation and billing.

2. Use of Services

Fair Use of Allocated Hours:
  • Clients are expected to utilize their monthly allocated hours within the scope of services described. Unused hours do not roll over to the subsequent month, except where explicitly stated in contractual agreements.
  • Excessive demands beyond the allocated hours without prior agreement will be billed at the agency’s standard hourly rates.

3. Client Responsibilities

Information and Cooperation:
  • Clients must provide all necessary information and cooperation required for the agency to effectively deliver the services. Delays caused by late or incomplete information may result in additional charges or impact the quality and timeliness of the service.

4. Revisions and Approvals

Revision Limits:
  • Each tier includes a set number of revisions for creative and strategic outputs. Additional revisions beyond this set number will incur extra charges, detailed in the client’s service contract.

5. Additional Support and Overages

Billing for Overages:
  • Any service requests beyond the scope of the agreed tiered hours will be clearly communicated and approved by the client before proceeding. These will be billed at an agreed-upon hourly rate.

6. Policy Enforcement

Enforcement of Terms:
  • The agency reserves the right to enforce the terms of this Fair Use Policy through various means, including service modification, suspension, or termination of service in cases of severe misuse or non-compliance.
Modifications to the Policy:
  • The agency may modify this policy from time to time to better align with industry standards and regulatory changes. Clients will be notified of any significant changes within a reasonable time frame.

7. Dispute Resolution

Resolution Procedures:
  • Disputes regarding the Fair Use Policy should first be addressed through internal dispute resolution mechanisms such as mediation. If unresolved, disputes may escalate to binding arbitration or legal action, depending on the terms of the service agreement.
